By accessing, using, playing on, or joining any of StoneHeart’s services, you are automatically bound by the terms outlined here. If you wish to no longer be bound by this document, you may stop accessing, using, and playing on all of StoneHeart’s services at any time.
StoneHeart reserves the right to update these terms at any time. It is your responsibility to review these terms periodically to ensure that you are aware of any changes that have been made.
Terminology
The terms “StoneHeart”, or “StoneHeart Gaming” refers to StoneHeart wholistically. The terms “staff”, “we”, “us”, and “our” refer to StoneHeart and our upper administration team.
The terms “Service” and “Services” refer to any service that StoneHeart provides, including our Minecraft Server(s), Websites, Forums, Discord, etc…
The terms “donor”, “member”, “user”, “you”, “your”, “player” refer to site visitors, and any other users of our services.
The terms “purchase” and “donation” refer to any purchase made on any of StoneHeart’s services, defined above.
The terms “Minecraft Server”, “Server”, “StoneHeart Server”, and “StoneHeart Minecraft Server”, refer to the Minecraft server provided by StoneHeart, stoneheart.net. StoneHeart is not affiliated with Mojang AB in any way.
Server Rules
By playing on StoneHeart’s Minecraft Server, you agree both to our rules, these terms, and those outlined in the
Minecraft End User License Agreeement (EULA). Breach of any of these, may result in either temporary or permanent suspension from all, or some of StoneHeart’s services at the discretion of StoneHeart administrators.
If a user is temporarily or permanently suspended from any of StoneHeart’s services, they have the right to a fair appeal by submitting a
Ban Appeal.
Donations and Purchases
PrivilegesUpon making a donation to StoneHeart, you may receive a number of in game privileges. These privileges are not tangible goods, nor aim to give donors an in-game advantage over any other player, in line with the
Minecraft EULA. These privileges are simply a “thank you” to players who choose to support StoneHeart.
Privileges are subject to change at any time. As such, any StoneHeart administrator may demote, promote, revoke, or modify your privileges at any time without warning.
Payment Method and Processing TimeStoneHeart uses PayPal as its payment processor for all transactions in order to ensure speed, security and reliability for all parties. All payments are routed through CraftingStore (
https://craftingstore.net)
Your privileges/rank should take no longer than 5 minutes to apply after we receive your payment, although this could be up to an hour. This process is automated and does not include PayPal’s processing times. If you do not receive your privileges with 1 hour, please contact a StoneHeart Moderator who will verify and manually apply your privileges.
Currency and FeesAll payment values stated on the StoneHeart shop are in United States Dollars (USD).
Unauthorised TransactionsAny donation made to StoneHeart must be made with expressed permission from the account/card holder. Payments made without such authorisation may result in a temporary or permanent suspension from some or all or StoneHeart’s services.
If an account/card holder finds an unauthorised transaction(s) to StoneHeart, they may contact
[email protected], where a member of the StoneHeart Administration Team will do their best to ascertain the source of the transaction(s) and issue refunds if appropriate.
RefundabilityAll purchases made to StoneHeart are non-refundable, unless otherwise stated in these terms. Following this, any chargebacks or PayPal refunds will result in permanent suspension from all of StoneHeart’s services.
In the event that a user is suspended from StoneHeart’s Minecraft Server, no refunds will be issued.

Applicability of TermsThese Terms constitute the entire agreement between you and StoneHeart, and supersede and extinguish all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter.
Data Handling
StoneHeart processes and uses your data in line with our Privacy Policy. Please read this carefully.
Our services are hosted in the United States, and therefore your data is processed in line with US laws. By accessing services from another region, you agree to your data being transferred to the United States for processing and storage.
Provision of Services
StoneHeart’s services are provided on an as-is and as-available basis. We have a number of measures in place to ensure maximum up time for all services, however, in the event that there are disruptions to services, you will not be entitled to any refunds for any purchases.
We reserve the right to suspend, transfer, rename, or discontinue any of our services at any time.
Liability
No points defined in these terms changes StoneHeart’s liability for: death/personal injury caused by our negligence, fraud, or any other loss or liability which may not be excluded or limited by law. Under no circumstances will we be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise howsoever arising from: any loss of profits, sales, business, or revenue, loss or corruption of data, information or software, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss.
Our total liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise howsoever arising, shall in no circumstances exceed the amount in USD of donations made to us in the 12 months preceding the liability.
We provide absolutely no warranties with any our services.
Indemnification
You agree to fully indemnify, hold harmless and defend StoneHeart and its staff from and against all claims, actions, demands, suits, liabilities, damages, losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses), judgements, settlements, costs and expenses (including, but not limited to reasonable attorney’s fees and costs), whether or not involving a third party claim, which arise out of or relate to (1) any breach of any representation or warranty of StoneHeart contained in this Agreement, (2) any breach or violation of any covenant or other obligation or duty of StoneHeart under this Agreement or under applicable law, (3) your breach or negligent performance or non-performance of any of these Terms, in each case whether or not caused by the negligence of StoneHeart or any other Indemnified Party and whether or not the relevant Claim has merit.
